FSPINK’s product inventory available on the site includes tens of thousands of products, and product listings are constantly being changed and updated. FSPINK’s customers are in various parts of the world. As a result, it is not practical for FSPINK to confirm whether import and sale of any of these products may conflict with local exclusive distribution rights in effect from time to time or otherwise constitute a violation of local law, including product safety and other regulations.

FSPINK makes every effort to ensure that the products it sells are genuine and legitimate. Import and sale of certain of the products offered on the site, however, may not be permissible in all countries, including without limitation the United States of America, as a result of local customs regulations, local copyright and trademark rights and other local laws. By purchasing a product through the site, customers outside of Hong Kong authorize FSPINK to plan for clearance of customs on their behalf for the products they have ordered.

Those who choose to access the site from outside Hong Kong, do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Payment, taxes and currency

Payment Method

FSPINK offers only PayPal® payments on the site. Please note that the payment method discussed below may not always be available. You agree to pay all charges associated with your purchases at the rates in effect when charges are incurred.

The user agreement for the PayPal service will govern your use of the service, and you must refer to that agreement and not these Terms of Use to determine your rights and liabilities as a PayPal. You, and not FSPINK, are responsible for paying any unauthorized amounts billed to your Paypal account by a third party. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify FSPINK of any discrepancies within sixty (60) days after you first receive notice thereof, you agree that they will be deemed accepted by you in all respects and for all purposes. If FSPINK does not receive payment through the Paypal service, you agree to pay all amounts due upon demand by FSPINK or its agents.

Unless expressly set forth on the site, FSPINK does not accept any other payment form. If FSPINK offers or accepts any other form of payment, you hereby agree to all restrictions, terms and conditions associated with such other form of payment.

Taxes

You are responsible for the payment of all applicable taxes (including, but not limited to, sales, use or value-added taxes) and other governmental fees, duties, charges, penalties, interest, and surcharges imposed on you in connection with such taxes and fees, or in connection with transactions and payments under these Terms of Use. Unless otherwise stated in each Purchase, all fees payable by you are exclusive of applicable taxes and duties, including, but not limited to, value-added taxes, excise taxes, sales and transaction taxes, and gross receipts taxes. For each purchase you make, FSPINK will automatically charge any applicable taxes and duties it deems necessary in any applicable jurisdiction.

Currency

Payments made through PayPal® in currencies other than U.S. dollars will be converted to U.S. dollars at an exchange rate determined by PayPal. Please review the PayPal service's User Agreement for information regarding its determination of exchange rates. These exchange rates may include a "spread", which is the amount payable to PayPal, which may cause the actual price paid to be higher than the published U.S. dollar price.

No refunds will be made to customers due to changes in exchange rates.

FSPINK does not offer cash refunds to customers. However, if any such refunds are to be made in the future to customers who previously paid in currencies other than U.S. dollars, and such refunds are made through PayPal, PayPal will determine the applicable exchange rate as set forth above.

Under no circumstances will any FSPINK Party be liable for fees or charges payable in connection with currency conversions or for any losses arising from currency exchange rate fluctuations.

Product information and prices

We cannot guarantee that any color display on your computer monitor will be accurate. Prices

We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Prices of products may increase or decrease between the time a product is placed in your "shopping cart" or "shopping bag" and the time of actual purchase. In addition, despite FSPINK's best efforts, a few Products on the Site may inadvertently display incorrect prices. FSPINK reserves the right to cancel any orders for Products listed at incorrect prices, discounts or refunds, containing other incorrect information or typographical errors, or products that are unavailable for any reason. FSPINK reserves the right to do so whether or not the order has been confirmed or your payment service has been charged. If your payment service has been charged for the purchase and your order is canceled, FSPINK will immediately issue a refund to your payment service in the appropriate amount.

Order processing, shipping, returns, warranties

Order Acceptance and Product Resale

We reserve the right to limit the order quantity on any product and/or refuse service to any customer without prior notice. We may also require verification of information prior to accepting and/or shipping any order. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel the quantities of purchases per person, per household or per order. Transfer of Ownership

Title to the Products and risk of loss of the Products will pass to you upon delivery to the common carrier selected by FSPINK to deliver your order.

Although the quantity delivered may be less than the quantity ordered, you are obligated to take delivery of any Products you order but any amount charged to you shall be adjusted to reflect that lower quantity. Any such quantity discrepancy shall not be deemed a material change in the terms of sale, nor shall it be deemed a breach or repudiation of FSPINK’s agreement to sell Products to you.

Returns

FSPINK accepts the return of most defective products, products damaged in transit and incorrectly sized products, subject to the terms and conditions published from time to time in the Refund Policy.

Replacement or repair of returned products will be made in accordance with the refund policy. Any refunds provided under the Refund Policy will be in the form of cash or store credit, depending on the return option selected by the customer.

Product warranty

FSPINK assumes no responsibility for any malfunctions or failures of products sold on the Site. Requests for technical service and support should be directed to the product manufacturer in accordance with the terms and conditions of any warranty provided by the manufacturer. Information regarding manufacturer's warranties is usually included in the materials accompanying the product or available through the Site.

Shipping Restrictions

Once an order is placed, it will be shipped to the address you specify, as long as the address complies with the shipping restrictions contained on the Site. All purchases from the Site are made subject to the conditions of shipment and acceptance of these terms and conditions through the use of the Site. FSPINK does not acquire title or other ownership rights in or to any Submission made by you. Dispute Resolution
